Scope of Application

The following General Terms and Conditions apply to all contracts, deliveries and other services. We hereby expressly object to any differing terms and conditions of the contractual partner. Any ancillary agreements require our written confirmation.
3D-Colors e.U. is entitled at any time to amend or supplement these General Terms and Conditions, including all possible annexes, with a reasonable notice period. Orders received prior to such amendments shall be processed according to the previously valid General Terms and Conditions.

Offer

3D-Colors e.U. operates an online shop. The offers on the internet represent a non-binding invitation for you to purchase goods.

After entering your data and clicking the order button, you submit a binding offer to conclude a purchase contract. Minor deviations and technical changes compared to our illustrations or descriptions are possible. In the event of typographical errors, printing errors, IT errors or calculation errors, 3D-Colors e.U. is entitled to withdraw from the contract.

Prices

3D-Colors e.U. is a retail business; therefore our prices are retail prices and, unless expressly stated otherwise, include statutory VAT, but exclude installation, transport costs and insurance.
All price information is without guarantee.
All prices are stated in euros.
The minimum order value is €10 net.

Price Validity

Services provided by 3D-Colors e.U. will be charged at the list price valid at the time the service is rendered.
The list price can be found in the current price lists of 3D-Colors e.U. in brochures and on the websites operated by 3D-Colors e.U.

Due Date and Payment, Default

Unless otherwise agreed in writing, orders for products from 3D-Colors e.U. are processed exclusively by prepayment.
If 3D-Colors e.U. suffers demonstrably higher damages caused by intentional deception, deliberate false orders or unjustified returns exceeding the granted right of withdrawal, 3D-Colors e.U. is entitled to claim such damages.

If an ordered parcel is not accepted, 3D-Colors e.U. reserves the right to charge the resulting handling costs.

In the event of payment default, the buyer undertakes to reimburse all costs associated with the out-of-court enforcement of claims, in particular reminder fees, collection agency costs and interest.

Payment Terms

The customer is obliged to pay the purchase price in full.

Payment conditions Austria

Accepted payment methods are:

• bank transfer

• eps payment

• cash payment upon pickup (cash on pickup)

For the payment method “cash on pickup” as well as for purchases made on site with cash payment, a surcharge of 10% of the sale price will be charged as compensation for the additional effort.

Self-collection from the shop after prior online order and online payment is free of charge.

Deliveries are made exclusively against prepayment.

Payment conditions EU countries

Deliveries within the EU are VAT-exempt, provided that the VAT ID number (USt-IdNr.) is communicated to us in advance.
Subsequent processing is not possible.
Once the VAT ID number has been communicated to us, the VAT exemption applies.

Deliveries to EU countries are made exclusively against prepayment.

Delivery

Delivery will take place only after payment has been received in the bank account of 3D-Colors e.U.

Orders are processed in the order in which they are received.

There is no minimum order quantity.

If it is indicated on the homepage that the seller is on company holidays or similar (hereinafter referred to as company holidays), shipping will take place after the end of the specified holiday period. In this case, the stated delivery time refers to the shipping period after the end of the company holidays.

Our stock availability is updated with every individual sale.

Delivery by cash on delivery (payment method: cash on pickup + shipping method: standard shipping) can only be realized for orders with a minimum goods value of €30.

Special shipping methods requested by customers will be charged with the usual local surcharge.

If a parcel cannot be delivered after several attempts, it will be returned to us. In this case we will charge a fee of €15 to cover the costs incurred.

Delivery Times

Goods that are in stock (we are not liable for transport problems) will, unless otherwise stated, be dispatched within 3 days after receipt of payment.

For furniture and bulky goods, the shipping time extends to approximately 3–4 weeks.

If the goods are not in stock at the time of ordering, we will endeavor to deliver them as quickly as possible.

If failure to meet a delivery deadline is due to force majeure, labor disputes, unforeseeable obstacles or other circumstances beyond our control, the delivery period will be extended accordingly.

If the delivery deadline is not met for reasons other than those mentioned above, the buyer is entitled to grant us a reasonable grace period in writing with the threat of refusal, and after its unsuccessful expiration may withdraw from the contract with regard to the delivery or service.

If the impossibility of delivery is due to the inability of the manufacturer or our supplier, both we and the buyer may withdraw from the contract if the agreed delivery date has been exceeded by more than two months.

Claims for damages due to delay, impossibility or non-performance, including those arising before withdrawal from the contract, are excluded unless a legal representative of 3D-Colors e.U. acted intentionally or with gross negligence.

Retention of Title

The goods remain the property of 3D-Colors e.U. until full payment has been made.

Complaints

Complaints must be reported in writing immediately upon receipt of the goods.
Complaints submitted at a later date unfortunately cannot be considered.

Right of Return

After receiving the goods, you have two weeks to return the ordered items in their original, undamaged and unused packaging together with the original invoice, after prior agreement.

Returned parcels without prior agreement will not be accepted.
The same applies to shipments sent freight collect.

The transport costs must always be borne by the buyer.

For returns made after the statutory deadline, 20% of the product value will be charged as a processing fee.

This applies only to undamaged/unopened goods whose expiration date lies far in the future.

Opened goods, as well as consumables and sterile products, cannot be returned.

Transfer of Risk

The risk passes to the buyer upon dispatch of the goods by 3D-Colors e.U..

Place of Jurisdiction

The place of jurisdiction and place of performance is Vienna, provided that the customer is not a consumer within the meaning of the Austrian Consumer Protection Act (KSchG).

Changes

We assume no liability for typographical, printing or calculation errors.

Deviations in visual representations cannot be completely excluded in individual cases.

Changes to the above provisions require written form.

Data Protection

The customer consents that the personal data contained in the purchase contract may be stored and processed by us with automated support for the purpose of fulfilling this contract.

You have the right at any time to receive free information, correction, blocking or deletion of your stored data.

The customer is obliged to inform us of any change of residential or business address as long as the contractual legal transaction has not yet been fully performed by both parties.

If such notification is omitted, declarations shall also be deemed delivered if sent to the last known address.

Plans, sketches and other technical documents, as well as samples, catalogues, brochures, illustrations and similar materials remain our intellectual property; the customer does not receive any rights of use or exploitation whatsoever.

We do not make your personal data available to third parties for their use.

Miscellaneous

If individual provisions of these General Terms and Conditions are legally invalid, the remaining provisions and contracts concluded on their basis shall remain valid.

The parties undertake to replace the invalid provision with a valid provision that comes closest in meaning and purpose to the invalid provision.

Courses

Terms and Conditions (AGB)

Registrations are considered in the order in which they are received. Registrations and cancellations for courses are accepted only in written form (also by fax or e-mail) or in person. Every registration is binding and is associated with the payment of the participation fee.

The participation fee must be paid no later than two weeks after the conclusion of the contract. Installment payments can only be agreed upon before the start of the event. In the case of a later entry into an event, no reduction of the participation fee is provided, and the same applies in the case of premature withdrawal. Any advance payments made will be deducted from the final total amount.

Cancellations are accepted only in written form. If a participant is unable to attend the event, a cancellation may be made up to 21 calendar days before the start of the event (according to the date of receipt) with a cancellation fee of 20% of the course costs. For cancellations received later than 21 calendar days before the start of the event, a cancellation fee of 50% of the course costs will be charged. In the case of cancellations on the first day of the event or thereafter, the full participation fee becomes due, even if installment payments had been agreed upon. Any advance payments made will be credited toward the cancellation fees. The cancellation fee is waived if the participant nominates a replacement participant belonging to the target group, who attends the event and pays the participation fee. However, the original participant remains liable for the course costs. In the case of an unforeseen illness of the participant, a medical certificate must be submitted.

If the booking of an event takes place by distance selling, in particular by telephone, fax, or e-mail, the participant, as a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), has a statutory right of withdrawal under the Distance Selling Act within 7 working days (Saturday does not count as a working day), calculated from the date of the conclusion of the contract. This does not apply to events that already begin within these 7 working days after the conclusion of the contract. The withdrawal period is considered met if the notice of withdrawal is sent within the deadline.

Due to long-term planning, program changes for organizational reasons are possible. The realization of an event also depends on a minimum number of participants. Therefore, any changes regarding course days, starting times, dates, and possible cancellations of events are reserved. Participants will be informed in good time and in an appropriate manner. In the event that a course is canceled due to illness of the trainer or other unforeseen circumstances, there is no entitlement to the execution of the event. No compensation for expenses incurred or other claims against 3D-Colors e.U. may be derived from such circumstances. The same applies to short-term necessary postponements or timetable changes within training programs. If an event must be canceled, the participation fees already paid will be refunded in full without deductions. The refund will be made by bank transfer to an account specified in writing by the participant. If course materials or equipment provided are not returned, the refund will be reduced accordingly.

3D-Colors e.U. reserves the right, in the presence of important reasons that make further participation unreasonable for other participants, lecturers, or staff, to exclude participants from attending the event and to withdraw from the contract. The course fee already paid will be refunded proportionally. In the event of payment default, there is the possibility to withdraw from the contract.

Certificates of participation confirming attendance at the event will be issued free of charge if the participant, unless otherwise specified, has attended at least 75% of the respective event.

In order to avoid copyright disputes, no video recordings, photographs, or audio recordings of learning materials, lectures, or persons may be made during an event without explicit permission. The materials provided during the courses may not be reproduced, distributed, offered for sale, made publicly accessible, or otherwise placed into circulation. 3D-Colors e.U. reserves the right to publish photographs of course participants and works created during the training on the company’s own websites as well as on its social media profiles and pages.

3D-Colors e.U. assumes no liability for personal belongings of participants, including the learning materials provided. No liability claims against 3D-Colors e.U. may be derived from the application of the knowledge acquired from 3D-Colors e.U..

All personal data of participants will be treated confidentially and in accordance with the applicable data protection laws. The data will not be passed on to third parties.

Supplementary Agreement for Members of the Tattoo Network

Discount Eligibility

Members of the Tattoo Network receive a special member discount when making purchases through TattooZeug. The amount and conditions of this discount are agreed separately and may be changed by TattooZeug at any time.

Proof of Membership

The entitlement to the member discount exists only upon presentation of valid proof of active membership in the Tattoo Network. This proof must be provided before completion of the purchase process.

Misuse

In the event of misuse of the discount, TattooZeug reserves the right to cancel the granted discount retroactively and request payment of the price difference.

Right of Modification

TattooZeug reserves the right to modify or revoke this supplementary agreement with a notice period of 14 days.
